User Responsibility and Liability

By using InLinked Platform, you accept full responsibility for:

• Scraping Legality: Ensuring you have a lawful basis (e.g., Legitimate Interest) to scrape and process the data of LinkedIn users in your target jurisdiction.
• Content Accuracy: Reviewing all AI-generated messages before sending. InLinked is not liable for "hallucinations" or inaccuracies produced by AI.
• All automated LinkedIn actions: Connection requests, messages, profile visits.
• Compliance with LinkedIn's terms: You are obligated to follow all LinkedIn guidelines.

AI Transparency & Disclosure Obligations

In compliance with the EU AI Act and global transparency standards, you agree to:

• Disclose AI Usage: Where required by law, you must inform recipients that their profile data was processed by an AI system or that the message they received was generated by AI.
• No Deepfakes: You must not use the platform to generate misleading content that impersonates a human being without disclosure.
• Human Oversight: You acknowledge that InLinked is a tool for assistance, not full autonomy. You maintain human oversight over all sent communications.

Indemnification Clause

You agree to indemnify and hold harmless InLinked Platform from any claims, damages, or legal actions arising from:

• Your failure to disclose AI usage to recipients.
• Data privacy violations resulting from your scraping activities.
• Violation of LinkedIn's User Agreement.
• Claims of harassment or spam from message recipients.

InLinked utilizes advanced Large Language Models (LLMs) to help you write personalized messages. To ensure safety and trust:

No Training on Customer Data

InLinked has established agreements with AI providers ensuring that your proprietary data and specific message contents are not used to train public AI models.

Prohibited Content

You may not use our AI features to generate:

• Hate speech, harassment, or discriminatory content.
• Fraudulent schemes or phishing attempts.
• Content that violates intellectual property rights.

Data Retention Policy

• Active Account Data: Retained while your account is active.
• Scraped LinkedIn Profiles: Stored temporarily to facilitate your campaigns. You may delete this data at any time via your dashboard.
• AI Generation Logs: Retained for 30 days for debugging, then deleted.

Cross-Border Data Transfers

As a user, if you scrape data of EU citizens while operating from outside the EU, you are responsible for ensuring appropriate safeguards for international data transfer.

Severability Clause

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Instead, such provisions shall be deleted without affecting the remaining provisions herein.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of Germany, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Leipzig/Sachsen for the resolution of any disputes.
